Welcome to Ceramic Raja. These Terms & Conditions govern your use of this website and any enquiry, purchase, commission, workshop, artwork service, or communication involving Ceramic Raja.
By accessing this website, submitting an enquiry, confirming an artwork purchase, or commissioning a work, you agree to these Terms & Conditions.
1. About Ceramic Raja
Ceramic Raja presents original paintings, ceramic works, murals, commissioned artworks, workshops, and related studio services.
Unless expressly stated otherwise, all artworks displayed or offered through Ceramic Raja are original handmade works by the artist or studio.
2. Artwork Availability
- Each original artwork is unique and may be available only once.
- An artwork shown on the website, social media, catalogue, or enquiry page may become unavailable before the website is updated.
- An enquiry does not reserve an artwork unless Ceramic Raja confirms the reservation in writing.
- Ceramic Raja may withdraw an artwork from sale before payment confirmation.
3. Artwork Information and Display
- Artwork titles, dimensions, materials, orientation, descriptions, and photographs are provided as accurately as reasonably possible.
- Handmade artworks may contain natural variations, texture, irregularities, visible brushwork, surface marks, and material differences. These form part of the character of an original work and are not necessarily defects.
- Colours may appear different on monitors, phones, tablets, photographs, or under different lighting conditions.
- Room previews, framing previews, scale references, and interior mock-ups are illustrative and may not represent exact scale, colour, framing, or placement.
- Buyers should confirm dimensions and relevant artwork details before completing a purchase.
4. Pricing and Taxes
- Prices may be shown in Indian Rupees unless otherwise stated.
- Prices may change without notice until an order or reservation is confirmed in writing.
- Packaging, framing, installation, insurance, taxes, shipping, customs duties, or international delivery charges may be additional unless specifically included.
- Any applicable tax or statutory charge will be included or added according to the invoice and applicable law.
- Custom quotations remain valid only for the period stated in the quotation.
5. Orders and Payment
- An order is confirmed only after Ceramic Raja issues written confirmation and receives the required payment.
- Accepted payment methods will be communicated during the enquiry or invoice process.
- Buyers must provide accurate billing, contact, and delivery information.
- Ceramic Raja may cancel or decline an order where payment cannot be verified, information is incomplete, the artwork is no longer available, or suspicious activity is identified.
- Ownership of the physical artwork transfers after full payment has been received, subject to any written agreement stating otherwise.
6. Commissioned Artworks
- A commissioned artwork begins only after the scope, size, material, approximate timeline, price, and advance payment are confirmed.
- The required advance payment will be communicated in the commission quotation.
- Commission timelines are estimates and may change depending on size, material, drying time, studio schedule, approvals, transport, or other circumstances.
- Reasonable approval stages may be offered where agreed. Excessive revisions or changes after approval may require additional time and cost.
- Because a commission remains an original artistic work, the final result may not be an exact mechanical reproduction of a reference image, sketch, mock-up, or earlier artwork.
- Advance payments for commissioned work may be non-refundable once materials have been purchased or work has started.
- Ceramic Raja may refuse requests that copy another artist, infringe third-party rights, contain unlawful material, or conflict with the studio's artistic practice.
7. Framing, Installation and Placement
- Framing, stretching, mounting, installation, and wall placement services are included only when expressly stated.
- Buyers are responsible for ensuring that walls, hooks, fixtures, and installation surfaces are suitable for the artwork's size and weight.
- Ceramic Raja is not responsible for damage caused by unsuitable walls, incorrect installation, third-party framing, moisture, direct sunlight, mishandling, or improper display.
- Placement and interior guidance is advisory unless a separate professional installation service is agreed.
8. Packaging, Shipping and Delivery
- Artwork will be packaged according to its size, surface, fragility, destination, and available transport method.
- Delivery dates are estimates and may be affected by courier delays, weather, customs, holidays, remote locations, or events beyond the studio's reasonable control.
- Buyers must provide a complete and accurate delivery address, mobile number, and any access information needed.
- Additional costs caused by an incorrect address, failed delivery, re-delivery, storage, customs delay, or refusal to accept delivery may be charged to the buyer.
- International buyers are responsible for customs duties, import taxes, permits, local charges, and destination-country requirements unless otherwise agreed.
- Ceramic Raja may use third-party couriers, packaging providers, or logistics partners.
9. Inspection and Damage During Delivery
- Buyers should inspect the external packaging before accepting delivery whenever possible.
- If the packaging or artwork appears damaged, photograph or record the unopened package, shipping label, outer packaging, inner packaging, and artwork.
- Report transit damage to Ceramic Raja within 48 hours of delivery.
- Keep all packaging until the matter has been reviewed.
- Claims reported without reasonable evidence or after the reporting period may be difficult to process.
- Ceramic Raja may arrange repair, replacement where possible, return, insurance coordination, or another reasonable solution after assessing the circumstances.
10. Returns, Exchanges and Cancellations
- Because original artworks are unique, returns and exchanges are not automatically available unless confirmed in writing or required by applicable law.
- Commissioned, personalised, framed-to-order, altered, reserved, or specially sourced artworks are generally not eligible for cancellation or return once work has started.
- A buyer should contact Ceramic Raja before returning any item. Unauthorised returns may not be accepted.
- Returned artworks must remain in their original condition and approved packaging.
- Where a return is approved for reasons unrelated to damage or error by Ceramic Raja, shipping, insurance, packaging, and transaction costs may be deducted or borne by the buyer.
- Nothing in these terms removes any non-waivable consumer rights available under applicable law.
11. Authenticity and Documentation
- Original artworks may be supplied with an authenticity certificate where applicable.
- The buyer should retain the invoice, certificate, artwork code, title, artist information, and related records.
- Authenticity certificates must not be altered, duplicated, transferred to another artwork, or used to misrepresent a reproduction as an original.
- Loss of documentation does not oblige Ceramic Raja to issue replacement documents without verification.
12. Copyright and Intellectual Property
All paintings, ceramics, murals, drawings, artwork images, photographs, videos, designs, logos, descriptions, written content, graphics, and other creative material displayed by Ceramic Raja remain protected by applicable intellectual property law.
- Purchasing a physical artwork does not transfer copyright, reproduction rights, licensing rights, publication rights, adaptation rights, or commercial-use rights unless expressly agreed in writing.
- Artwork images may not be downloaded, copied, saved, printed, reproduced, traced, redrawn, photographed, scanned, republished, distributed, sold, or commercially used without prior written permission.
- Artwork images must not be used for posters, prints, merchandise, packaging, clothing, catalogues, advertisements, websites, social media businesses, NFTs, digital products, or commercial promotions without permission.
- Users must not remove watermarks, alter signatures, crop, recolour, add filters, modify, distort, or falsely claim ownership or authorship.
- Artwork, images, and written content must not be used for AI training, machine-learning datasets, image-generation datasets, style replication, or automated content systems without written authorisation.
- Limited use permitted by applicable law is not restricted by these terms.
13. Website Use
You may use this website for lawful personal browsing, artwork enquiry, purchase consideration, and communication with Ceramic Raja.
You must not:
- Attempt unauthorised access to the website, server, accounts, forms, databases, or administrative areas.
- Introduce malware, harmful scripts, automated scraping, bots, spam, or disruptive code.
- Copy or reproduce the website design, catalogue, text, images, code, or branding without permission.
- Use website content to mislead customers, impersonate Ceramic Raja, or advertise unauthorised products.
- Submit false, unlawful, offensive, infringing, or fraudulent information through any form or communication channel.
14. Third-Party Services and Links
The website may contain links to Instagram, Facebook, WhatsApp, payment services, couriers, maps, or other external platforms.
Ceramic Raja does not control third-party services and is not responsible for their availability, content, security, terms, privacy practices, charges, or performance.
15. Workshops and Studio Visits
- Workshop and studio-visit availability, timing, fees, materials, age requirements, and capacity may vary.
- A place is confirmed only after written confirmation and any required payment.
- Participants must follow studio safety, handling, and conduct instructions.
- Photography or recording may be restricted where artwork, privacy, or intellectual property is involved.
- Ceramic Raja may reschedule or cancel a session because of insufficient participation, artist availability, safety, or circumstances beyond reasonable control.
16. Limitation of Liability
To the extent permitted by law, Ceramic Raja is not liable for indirect, incidental, special, or consequential loss arising from website use, delays, third-party services, improper handling, unsuitable installation, environmental damage, or unauthorised use of artwork.
Nothing in these Terms limits liability that cannot legally be excluded or restricted.
17. Force Majeure
Ceramic Raja will not be responsible for delay or failure caused by events beyond reasonable control, including natural disasters, fire, flood, transport disruption, courier delay, labour action, government restriction, internet failure, epidemic, civil disturbance, or material shortage.
18. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of India. Subject to applicable consumer law and mandatory legal rights, disputes shall be subject to the jurisdiction of the competent courts in Pune, Maharashtra.
19. Changes to These Terms
Ceramic Raja may update these Terms & Conditions when the website, products, services, pricing, delivery methods, or legal requirements change.
